II. DEFINITIONS
(1) The following definitions are used in the Rules and Regulations:
Online Store - a store operating at www.sportplus.pl, selling goods via the Internet.
Seller - SPORTPLUS.PL Sp. z o.o. with headquarters in Myślenice, ul. Słowackiego 75A, 32-400 Myślenice, REGON no.: 381867650, NIP 6812073848.
Customer - a natural person with legal capacity, or an organizational unit that has legal capacity under the law - entering into a remote agreement with the Seller.
Order processing time - the time it takes for the Online Store to complete an order and have it shipped by the form of delivery chosen by the Customer.
Working days - all days of the week from Monday to Friday, excluding public holidays.
Prices - prices of goods presented on the website www.sportplus.pl are given in Polish zloty and include VAT.
III. OFFER
(1) Any information regarding goods addressed by the SPORTPLUS store to customers and potential customers does not constitute an offer within the meaning of the law, but is only an invitation to start negotiations.
IV. PLACING ORDERS
(1) A prerequisite for the commencement of use of the Store is familiarization with and acceptance of these Regulations.
(2) The SPORTPLUS.PL Store allows you to place an order in one of the following ways:
- through the website www.sportplus.pl;
- via e-mail sent to sklep@sportplus.pl;
- by telephone, during the store staff's working hours.
(3) Use of the online store www.sportplus.pl and placing orders is possible when the user has the following equipment:
- PC-class computer, or a mobile device equipped with an operating system and capable of connecting to the Internet;
- Internet connection;
- a correctly configured web browser that supports HTML, JavaScript and CSS standards;
- Cookies and JavaScript support enabled
- an active e-mail account.
(4) When placing an order via the Store website, the customer does so through an interactive purchase form. The order specifies what goods, at what price and in what quantities the customer wants to order to the location of his choice. The buyer also indicates the methods of delivery and payment for the ordered products.
(5) The process of correctly placing an order results in the sending of information about the order to the Customer's e-mail address. This message is not a confirmation of acceptance of the customer's offer, but only information about the acceptance of the order by the Seller.
6. information about the approval of the order for execution goes to the Customer by e-mail - as a separate message, which is a confirmation of positive verification of the order by the Seller.
V. DELIVERY
(1) Goods ordered in the online store www.sportplus.pl are delivered via one of the available carriers (courier, company transport) selected in the process of submitting a purchase offer.
(2) The time of receipt of the parcel by the customer consists of: the time of execution of the order (completion and preparation for shipment) and the time of delivery, depending on the selected method of delivery of the goods - only working days are taken into account.

Products are in the main warehouse. If the order was received and confirmed with payment by 11:00 - the goods will be shipped within 24 hours.

The product is out of the main warehouse, the time to bring to the warehouse and dispatch is 2 to 5 working days.

The product is available on request. To determine the lead time, please contact our salesman.
7.Along with the goods are issued a VAT invoice or fiscal receipt (as requested by the customer) with the terms of the warranty, and for selected products - a manufacturer's warranty document. In the absence of any of these documents, the customer must report such an event in order to complete the deficiency by contacting the staff of the SPORTPLUS.PL store.
(8) The customer has the opportunity in the presence of the forwarder (deliverer), to check the contents of the package for damage during transport. If the buyer finds such damage, it is necessary in the presence of the forwarder to draw up a protocol necessary for the recognition of the complaint.
(9) The customer is informed about the methods and costs of delivery before finalizing the order. When placing an order, he can choose any other available method of delivery and payment.
10.Transport costs are valid in Poland.
VI. METHODS OF PAYMENT AND PRICES
(1) The SPORTPLUS.PL store provides the following methods of payment, which it informs before confirming the order:
- payment by cash on delivery,
- payment in cash upon personal collection,
- payment by traditional transfer to the store's bank account,
- electronic payment and payment card payments via PayU.pl.

VII. RETURN OF GOODS BY THE CONSUMER
(1) A consumer who has entered into a remote contract may withdraw from the contract within 14 days without stating a reason and without incurring costs, except for the costs specified in Article 33, Article 34 us t. 2 and Article 35 of the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014.827). The consumer may withdraw from the contract by making the appropriate statement in writing - a form.

(2) Return of the item to the seller should take place immediately, but no later than within 14 days of withdrawal from the contract. The cost of returning the shipment shall be borne by the purchaser.
(3) If the consumer exercises the right to withdraw from the contract after making a request in accordance with Article 15 us t. 3 and Article 21 us t. 2 of the aforementioned Act of May 30, 2014 on consumer rights (Journal of Laws 2014.827), he is obliged to pay for the services performed until the withdrawal from the contract.
(4) The right to withdraw from an agreement concluded off-premises or at a distance shall not be granted to the consumer in situations described in Article 38 of the Act of May 30, 2014 on Consumer Rights (Dz.U.2014.827), including with respect to agreements:
1) for the provision of services, if the entrepreneur has performed the service in full with the express consent of the consumer, who was informed before the start of the service that after the performance by the entrepreneur will lose the right to withdraw from the contract;
2) in which the subject of performance is an item produced to the consumer's specifications (non-refabricated);
3) in which the subject of the performance is an item that is perishable or has a short shelf life;
4) in which the subject of the performance is an item delivered in a sealed package that cannot be returned after opening the package for health or hygienic reasons, if the package has been opened after delivery;
5) in which the subject of performance is sound or visual recordings or computer programs delivered in sealed packaging, if the packaging has been opened after delivery;
6) for the supply of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the consumer before the expiration of the deadline for withdrawal from the contract and after the entrepreneur has informed him of the loss of the right of withdrawal.
VIII. QUALITY GUARANTEE
(1) All goods offered in the store SPORTPLUS.PL are brand new, placed in packaging (if applicable), in the condition provided by the manufacturer.
All products are guaranteed by the manufacturer, importer or seller. The usual warranty period is a minimum of 24 months , and any possible deviation (extension of the warranty period) from this rule is indicated in the product description.
(2) It is essential to keep a proof of purchase of the product (receipt, VAT invoice) issued by the seller and attach this document in the event of a claim under the guarantee provided by the store SPORTPLUS.PL.
(3) The Customer's entitlements under the granted Guarantee shall automatically expire:
- after the warranty period expires;
- in case of making any changes or modifications by the customer;
- in case of using the goods in a manner inconsistent with their intended use.
(4) Notification of a defect in the goods by the Customer and initiation of the complaint procedure shall take place upon receipt by SPORTPLUS.PL of the Customer's statement on notification of a defect in the goods and the defective goods. SPORTPLUS.PL considers complaints no later than within 14 working days from their receipt. If it is necessary to send the defective goods or their parts to the manufacturer's services, the period of processing a warranty claim may be extended to 28 working days.
(5) The method of delivery of equipment for warranty repair: the customer of the online store is obliged to send the equipment at his own expense.
6) In the event that in the course of the analysis of the validity of the complaint and visual inspection of the defective goods or their parts , SPORTPLUS.PL finds that the conditions of the warranty granted have been violated, in particular, the goods or their parts have been modified in terms of physical properties, SPORTPLUS.PL will inform the customer of this, returning the defective goods to the customer at his expense and risk, and the customer is obliged to cover the costs incurred by SPORTPLUS.PL.
(7) The customer should deliver the defective goods to the SPORTPLUS.PL store in the original factory packaging in which the goods were received by the customer. In case of difficulties, the customer may deliver the goods in substitute packaging, which will provide an adequate level of protection for the goods during transportation.
(8) The warranty on the sold consumer goods does not exclude, limit or suspend the rights of the buyer against the seller of consumer goods under the provisions of the warranty for defects of the sold thing.
Complaint procedure
(9) If the purchased goods contain defects, the cost of returning the goods is covered by the SPORTPLUS.PL store. The reported defect in the goods is subject to verification by the store staff, who will determine whether the defect in the goods existed at the time of issue.
(10) The delivery of goods under the complaint is necessary. In order to identify it, it is advisable to fill out a complaint form and send it back by mail or e-mail to the address of the SPORTPLUS.PL store.

IX. PROTECTION OF PERSONAL DATA
(1) By registering in the SPORTPLUS.PL store, the Customer voluntarily agrees to the processing of his/her personal data, retaining the right to inspect, correct and delete them from the address database. Personal data is provided on a voluntary basis, however, failure to provide the required information will result in the Buyer not being able to create an account in the Store, and thus make purchases in it.
(2) Personal data shall be processed by the Online Store in accordance with the rules arising from the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as "RODO") and national legislation.

(5) Personal data shall be processed for the establishment of an account, acceptance and execution of an order, shipment of goods and possible handling of complaints.
(6) Only authorized employees of the Online Store have access to personal data. Recipients of the data, however, may be:
- partners of the Store with whom the Store cooperates
- accounting, legal, IT and insurance companies acting on behalf of the Store
- courier companies
- entities handling electronic payments.
(7) Buyer's personal data will be processed for the duration of the order, until the expiration of claims related to this order, regulated by separate regulations or until the expiration of the obligation to store accounting documents by the Online Store.
(8) During a visit to the website of the SPORTPLUS.PL store, cookies (text files stored on the User's computer) are collected automatically. Their role is to collect information related to the user's use of the Store.
(9) In connection with the processing of personal data by the Online Store, the Buyer is entitled to:
- access to the data (information about the processed data and to obtain a copy of the data);
- rectification (correction) of data;
- deletion of data processed unjustifiably;
- limitation of data processing (withholding operations on the data or not deleting the data);
- object to the processing, if it is carried out on the basis of Article 6(1)(f) of the RODO;
- transfer of data to another controller.
(10) If the Buyer believes that the processing of data is carried out in violation of the law, he is entitled to file a complaint with the President of the Office for Personal Data Protection.
X. COOKIE POLICY
(1) In addition to the personal data that the Store available at https://www.sportplus.pl collects from its customers, the Store also collects other information that does not constitute personal data, but comes from:
- Server logs - information regarding the use of the website by customers and their IP addresses is collected by analyzing access logs. This information is used both for technical purposes, related to the administration of the website, as well as for statistical purposes. The information from server logs is anonymous and does not allow to identify the user.
- Cookies - are information that the server saves in the memory of the client's browser, so that it can be "recognized" when the client visits again. It is possible to disable cookies in the settings of the browser - this hinders the use of the Store, but does not prevent it. The information from cookies is anonymous and does not allow to identify the user.
